The United States Citizenship and Immigration Services (USCIS) announced on January 3, 2023, that filing fees for the EB-5 Program will be subject to increase as part of a comprehensive fee review at the agency.

The USCIS cites the EB-5 Reform and Integrity Act of 2022, which requires the agency to set fees that are sufficient to recover the costs of processing investor petitions within an improved timeframe of 120 to 240 days. See the below chart indicating the current and increased fees and the percentage increases.

The proposed fee for Form I-526E, Immigrant Petition by Regional Center Investor, is $11,160, a 204% increase from the current fee of $3,675. Similarly, the proposed fee for Form I-829, Petition by Investor to Remove Conditions on Permanent Resident Status, is $9,525, a 154% increase from the current fee of $3,750.

A 60-day public comment period is in place before the fee increase takes effect. To avoid potential increased costs, it is recommended to file I-526E forms as soon as possible, but certainly prior to March 2023.
